The Bombay High Court has acquitted
a police constable, sentenced to 15 years' imprisonment by a
trial court for allegedly raping a minor, after concluding
that prosecution had failed to prove the charge against him.
The High Court said that he could have been convicted only
for attempt to rape and since he had already been in jail for
more than five years, he should be released.
Chandrakant Pawar (47), attached to Sahar police station
as a head constable at the time of the incident, was accused
of kidnapping and raping a 15-year-old beggar in October 2005.
He was convicted by the sessions court in July 2006.
Justice J H Bhatia, however, overturned the lower court's
decision, holding that medical evidence did not prove sexual
intercourse.
"The prosecution has failed to prove beyond reasonable
doubt that the accused had actually committed rape, though
there is strong evidence that he attempted to commit rape....
Hence the accused is liable to be convicted only for attempt
to rape," the High Court said.
The judge further said that Pawar had already been in
jail for more than five years (since his arrest on October 18,
2005), so he need not undergo further sentence on the count of
attempt to rape.
According to the prosecution, on the night of October 17,
2005, Pawar forcibly took the victim, who begged at a signal
near the Mumbai airport, to a secluded place and raped her.
Afterwards, when he was about to take the girl back to the
spot from where he had picked her up, another police
constable, suspecting something amiss, took them to police
station. The girl had then lodged the complaint of rape.

Goa Police: सलामी शस्त्र करना भूला कांस्टेबल, तो डीजीपी साहब ने सस्पेंड किया
MAPUSA: A police constable attached to the Mapusa police station found that he didn't know the formal salutation after DGP Aditya Arya conducted a surprise visit to the police station on Thursday.
Speaking to TOI, Arya said "I have suspended the constable because he does not know how to do the 'Salami Shastra' salute".
Continuing his surprise visits to police stations "for better functioning of the police force", the DGP on Thursday morning, as a common man, visited Mapusa police station in civilian clothes. Sources said, that he visited the office of the PI in-charge of the police station and later walked up to the police lock-up area and saw for himself the situation in and around the police station.
On seeing the DGP, the constable Santosh Sawant saluted the police chief but he didn't do it properly. Sawant (buckle number 5415) could not present the proper 'arms' - formal salutation of 'salami shastra' to DGP Arya, sources said.
"Sawant is suspended under powers of sub rule (1) of the rule 12 of the Goa police subordinate service (discipline and appeal) rule 1975, read with Section 7 of the police act 1861,"said deputy superintendent of police Sammy Tavares.
The DGP also said that every one should get a chance to learn. "I have told him (constable) that once he learns the 'salami shastra' properly, he will be reinstated," Arya said.
Earlier, Arya had visited the police stations in Porvorim and Calangute. "I am going to police stations as a common man to know how they behave with the common man. So that, mistakes can be rectified and they work properly and every person visiting police stations should be treated sympathetically,"Arya said.

Kerala Police: Neighbourhood police system launched in Coimbatore
COIMBATORE: The city police on Thursday launched 'Neighbourhood Police' system in Coimbatore. Under the system, specific areas and streets will be assigned to special sub–inspectors (SSIs) and sub-inspectors under Law and Order officials of the respective police station. Their numbers will be made available to the public and stuck on strategic locations in the neighbourhood so that they can be contacted during emergency situations.
City police commissioner Amaresh Pujari said that the public of Coimbatore can identify their area police and avail their number. They can share their problem without hesitation and the police will take action. "There is a growing gap between public and police. We have to bridge this gap with effective policing," said Amaresh Pujari.
The initiative was officially inaugurated by district collector M Karunagaran who also stressed on the importance of the initiative to curb crime and maintain the law and order scenario in the city. The officers involved in the project will be given special visiting cards and also asked to conduct daily half an hour sessions with the inspector of law and order units in the city.
